ABA Formal Opinion 512

ABA Formal Opinion 512 (2023) addresses an attorney's ethical duties when using generative AI tools that process client information. Under Rules 1.1 (Competence), 1.6 (Confidentiality), and 5.3 (Supervision of Non-Lawyers), attorneys must take reasonable measures to prevent unauthorized disclosure of client data when using any third-party technology.

AI Processing

About the AI Processing

Document conversion and PII detection are powered by Claude AI, developed by Anthropic, via their API. We use the API exclusively — we do not use Anthropic's consumer products, which have different data handling terms.

Anthropic's API operates under a zero-retention policy for API calls: by default, Anthropic does not store the content of API requests or responses, and does not use API inputs to train their models. This is separate from and more protective than their consumer-facing products.
